Portland Courthouse Riots: DOMESTIC TERRORISM

When in doubt, REVIEW THE LAW.

As per 18 U.S. Code § 2102. Definitions, the Portland courthouse riots were, most certainly, riots:

(a)As used in this chapter, the term “riot” means a public disturbance involving

(1) an act or acts of violence by one or more persons part of an assemblage of three or more persons, which act or acts shall constitute a clear and present danger of, or shall result in, damage or injury to the property of any other person or to the person of any other individual or

(2) a threat or threats of the commission of an act or acts of violence by one or more persons part of an assemblage of three or more persons having, individually or collectively, the ability of immediate execution of such threat or threats, where the performance of the threatened act or acts of violence would constitute a clear and present danger of, or would result in, damage or injury to the property of any other person or to the person of any other individual.

Furthermore, the second paragraph, properly applied by most Senate Reublicans, completely exonerates President Trump:

(b)As used in this chapter, the term “to incite a riot”, or “to organize, promote, encourage, participate in, or carry on a riot”, includes, but is not limited to, urging or instigating other persons to riot, but shall not be deemed to mean the mere oral or written

(1) advocacy of ideas or

(2) expression of belief, not involving advocacy of any act or acts of violence or assertion of the rightness of, or the right to commit, any such act or acts.

But did they constitute “domestic terrorism?”

Again, let’s REVIEW THE LAW!

18 U.S. Code § 2331 – Definitions(5)the term “domestic terrorism” means activities that—

(A)involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;

(B)appear to be intended—

(i)to intimidate or coerce a civilian population;(ii)to influence the policy of a government by intimidation or coercion; OR

(iii)to affect the conduct of a government by mass destruction, assassination, or kidnapping; AND

(C)occur primarily within the territorial jurisdiction of the United States; and

Key word: “OR” in (B)(ii). When used it requires any of the three, (i) to (iii), to be present in order to meet the the intention requirement stated in (B)

Key word: “AND” in (B)(iii). When used, it requires all three of (A) through (C) to be present in order to meet the definition requirement stated in (5).

So, let’s review within the context of the Portland courthouse riots:

(5)the term “domestic terrorism” means activities that—

(A)involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;

MET

(B)appear to be intended—(i)to intimidate or coerce a civilian population;

MET

(ii)to influence the policy of a government by intimidation or coercion; OR

MET

(iii)to affect the conduct of a government by mass destruction, assassination, or kidnapping; AND

MET

(C)occur primarily within the territorial jurisdiction of the United States; and

MET

Looks like it’s a 100% shutout, a slam-dunk!

The Portland courthouse riots are — ABSOLUTELY — domestic terrorism.
