When I carry my firearm in accordance with our United States Constitution’s Second Amendment which states “the right of the people to keep and bear arms SHALL NOT be infringed,” I am NOT using force against others.
I am reserving to myself the lawful use of force should someone else initiate an unlawful use of force against me.
But when AntiFa approaches, attacks, and beats upon others, they ARE using force, and they’re using it in a most heinous and unlawful manner:
18 USC Ch. 113B: TERRORISMFrom Title 18—CRIMES AND CRIMINAL PROCEDUREPART I—CRIMESCHAPTER 113B—TERRORISM§2331.
(5) the term “domestic terrorism” means activities that—(A) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;(B) appear to be intended—(i) to intimidate or coerce a civilian population;(ii) to influence the policy of a government by intimidation or coercion; or(iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and(C) occur primarily within the territorial jurisdiction of the United States;
(i), (ii), and (iii) are all “or” requirements, as clearly indicated by the big, fat “or” between (ii) and (iii). Only one of these three criteria need be met in order to satisfy the requirements of (B). Meanwhile, (A), (B), and (C) are all “and” requirements. All three must be met.
In light of the above, We the People have questions regarding AntiFa’s actions:
1. Have their acts been dangerous to human life? Stopping traffic is most certainly dangerous to human life, and AntiFa has proudly done just that on multiple occasions while continue to call for more. They have inflicted head wounds, which certainly are life-threatening. They have routinely been caught attempting to bring pipes, steel rods, tire irons, and even explosives, not to mention other implements of mayhem and death into the midst of their counter-protests. Members have been charged with crimes up to and including aggravated assault as well as battery (or in states with assault only laws, then on the books forms of assault where violence was actually committed against another person).
Thus, (5)(A) was certainly satisfied.
2. AntiFa itself routinely claims, including on it’s “RefuseFascism.org” website, that it’s all about intimidating and/or coercing civilian populations (i) into dumping Trump and Pence (ii). Indeed, the headlines on their own website read, “Andy Zee and Coco Das on the Michael Slate Show 8/16/19: “People need to realize this is not a pendulum swing…” One banner reads, “Drive out Trump/Pence by sustained mass protest! RefuseFascism.org.”
Nothing says, “intimidation or coercion of a civilian population” like shutting down and completely blocking public highways along which people are trying to travel.
Thus, both (i) and (ii) are satisfied, even though only one of the three needs be satisfied to meet the definition of domestic terrorism.
3. AntiFa’s events have all occurred “primarily within the territorial jurisdiction of the United States.
Thus, (C) is satisfied.
CONCLUSION: When (5)(A), (B)(i), (ii) or (iii), and (C) are satisfied, do you know what you have?
There is absolutely no question that AntiFa, as an organization, from its leaders to its website to its members and oft-repeated actions in the streets, has been committing domestic terrorism, and pushes to continue their intimidation and coercion of our civilian population, including acts dangerous to human life that are a violation of the criminal laws of the United States or of any State.
There is absolutely no question that AntiFa has been committing domestic terrorism.
QUERY: Given all the above, why haven’t they been charged , prosecuted, and given their day in federal court?
Is it because they haven’t “(iii) affect[ed]the conduct of a government by mass destruction, assassination, or kidnapping?” and therefore the federal government doesn’t want to deal with them?
That’s only one criteria. Lack of that one criteria doesn’t give the federal government a pass to turn a blind eye to the problem of domestic terrorism when either of the other two criteria are satisfied, as both have been determined to be.
Is it because the federal government is afraid of an even greater backlash if they did do what the Constitution, federal law and the honest, law-abiding citizens of this country require them to do?
Raising kids, there was about a 1 in 3 chance that a spanking would produce a rousing wave of protests. That was best solved by a second spanking, along with a very clear talk as to why the second spanking was necessary.
However, I quickly learned I could usually headed off any rousing waves of protest at the pass by prefacing the first spanking with a very clear talk as to why it was necessary.
Either way, they still received a spanking for their improper behavior.
What is NEVER acceptable, however, is allowing improper, or in AntiFa’s case, highly illegal behavior to continue.
Congressman, I must ask you these two questions:
What WILL our government do to stop AntiFa’s highly illegal domestic terrorism, BEFORE other groups get the idea they can do the same?
When WILL our federal government take the necessary action as required by law?
“In August 2017 a petition was lodged with the White House petitioning system “We the People” calling upon the government to formally classify “AntiFa” as terrorist. The White House responded in 2018 that federal law does not have a mechanism for formally designating domestic terrorist organizations.”
NOT TRUE. I just demonstrated how federal law applies. Here’s the mechanism, contained in the very next section: You CHARGE them with meeting 18 USC 113B §2331 and violating subsequent sections like §2332. Criminal penalties, where para (c) Other Conduct clearly applies:
(c) Other Conduct.—Whoever outside the United States engages in physical violence—(1) with intent to cause serious bodily injury to a national of the United States; or(2) with the result that serious bodily injury is caused to a national of the United States; shall be fined under this title or imprisoned not more than ten years, or both.(d) Limitation on Prosecution.—No prosecution for any offense described in this section shall be undertaken by the United States except on written certification of the Attorney General or the highest ranking subordinate of the Attorney General with responsibility for criminal prosecutions that, in the judgment of the certifying official, such offense was intended to coerce, intimidate, or retaliate against a government or a civilian population.
It’s right there in black and white, so again, why isn’t action being taken against AntiFa while it’s ONLY AntiFa? Why wait until additional group get the notion they can commit domestic terrorism without repercussion?
Even typically leftist individuals are being beaten by AntiFa terrorists:
No single incident demonstrates more clearly the current mentality of the Progressive Left than that which happened to a reporter covering an Antifa demonstration in Portland, Oregon. This is Andy Ngo’s own words, which he wrote in the Wall Street Journal:
“I was suddenly slammed on the back of my head with something hard… I was… punched and kicked by perhaps a dozen masked people in black. At an Antifa event … I, a gay journalist of color, was beaten so badly that I was hospitalized for a brain hemorrhage…I have been targeted by Antifa and its allies for my critical coverage of their violent extremism. I’ve reported those incidents to the Portland Police Bureau, and in some cases I’ve identified suspects, but there were no arrests…”

Antifa is not an outlier. It is, in fact, simply the most visible example of what the Progressive Left is. When some disappointed Clinton voters took to the streets and engaged in violence to protest the results of a fair and honest election that they lost in 2016, they expressed their ideology precisely: Surrender to us or be attacked. Hillary Clinton, when asked during a debate what her definition of what the “enemy” is, didn’t say poverty, discrimination, disease, war, Russia or China. To the left, fellow Americans who refuse to kowtow to them are indeed the enemy.
I respectfully implore you to take action, or at least strongly recommend the Department of Justice take action. America absolutely cannot allow these violent crimes against our people, our government, and humanity to continue.
